The use of mediation and arbitration is an increasingly popular option for resolving conflicts. It serves as a more cost effective and less stressful approach versus traditional courtroom battles. Our law firm has particular expertise in this form of legal services. Our success is grounded in our depth of legal knowledge and our talents for persuasive negotiating. Before you decide to engage your adversary in a lengthy and expensive lawsuit we strongly recommend that you consider the use of our mediation, arbitration and litigation services.

The Difference Between Arbitration, Mediation & Litigation

Litigation is civil warfare. One party files a lawsuit and the other files a counter suit which leads to an expensive, time consuming battle. Litigation is almost always an emotional rollercoaster and causes much stress for anyone involved. Despite the quality of your case, the capabilities of your attorney or even common sense, your result comes from an unpredictable jury. We are very experienced in achieving successful outcomes from jury trials, however, we often recommend consideration of our mediation or arbitration services. While litigation is common, arbitration and mediation, if feasible, are better methods to resolve legal issues and disputes.

Arbitration and mediation have many similarities, there are differences as well. Either approach can yield a binding and enforceable agreement, however mediation is typically non-binding, whereas arbitration typically produces a binding result. Either approach can be utilized to facilitate a less contentious litigation process. Both arbitration and mediation employ neutral parties, usually attorneys not involved in the case, which seek to remove emotion while arriving at a mutually agreeable settlement.

Arbitration can use a single neutral party or be a collaborative effort of multiple neutral parties. The arbitrator(s) act in a manner similar to a judge in how they review facts and information to produce a decision. The written decision can be drafted into a formal settlement that becomes a legally binding agreement and closes the legal struggle.

Mediation typically utilizes only one neutral party who serves as a facilitator for constructive communication in a manner similar to a counselor. Mediation is most successful when the opposing parties seek closure without a highly emotionally charged agenda. When using a mediator both sides can more directly plead their case without the posturing of opposing attorneys. If your legal problem or situation is relatively simple, or has only a few areas of contention, then mediation may be your best option to resolve the conflict.

The Advantages of Arbitration and Mediation

Time, cost and emotional distress can be minimized through arbitration and mediation. First, you can avoid lengthy delays of court dates which can drag a seemingly simple issue through years of fighting in and out of court. Second, trial preparation is expensive for both sides. Unless you can exhaust the financial resources of your opponent, the total cost of resolving your case has no limit. Rates for arbitration and mediation services can be very affordable - even if the arbitrator or mediator is an attorney. Third, by minimizing the time and cost required to achieve a settlement, your emotional turmoil will be greatly reduced.
